By using Oh Fax you agree to these Terms. If you use Oh Fax through an agent or API, you are responsible for that use.
Oh Fax provides outbound fax transmission to US and Canada destinations from PDFs you supply. Features may include browser send, prepaid API keys, CLI, and MCP/agent access. We may modify or discontinue features with reasonable notice when practical.
You must use the service lawfully. You may not:

Prices are shown before you pay (quote or checkout). Binding agent/MPP amounts are those in the payment challenge. Payments are processed by Stripe and related rails. Prepaid balances are for Oh Fax usage and are generally non-transferable. Undeliverable faxes (busy, no answer, not a fax, etc.) are refunded per our posted policy; successfully delivered faxes are not refundable. Taxes may apply.
You retain rights to your content. You grant us a limited license to process and transmit it to provide the service. You represent you have the right to send the materials and that the destination is appropriate.
The service is provided “as is.” Fax networks can fail; we work to deliver and to refund undeliverable jobs as described, but we do not guarantee delivery times or third-party network behavior. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by law, Oh Fax and its operator are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits/data. Our total liability for a claim relating to a fax is limited to the amount you paid for that fax (or $50 if greater liability cannot be limited).
You will indemnify us against claims arising from your content, destinations, or unlawful use of the service.
If an AI agent or third-party client uses your credentials or pays on your behalf, you remain responsible for the resulting faxes and charges.
These Terms are governed by the laws applicable in British Columbia, Canada, without regard to conflict-of-law rules, unless mandatory consumer law says otherwise.
